Terms of Service

These Terms of Service ("Terms") govern your access to and use of niles.dev, the niles dashboard, and the niles deploy platform (together, the "Service") provided by niles ("niles", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

1. The Service

niles provides hosted deploy slots for projects — a live preview URL with a database, HTTP API, and storage — together with related tools and dashboards. We may add, change, or remove features over time. We may also impose or change usage limits (for example on compute, storage, bandwidth, or requests) for any plan.

2. Accounts

You must provide accurate information when you register and keep it up to date.
You are responsible for all activity under your account and for keeping your credentials secure.
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service.
Notify us promptly at [email protected] if you suspect unauthorized use of your account.

3. Plans, billing, and trials

Paid plans are billed in advance on a recurring basis (monthly or as otherwise stated at checkout) through our payment processor. Fees are quoted in U.S. dollars and exclude taxes, which you are responsible for.
Subscriptions renew automatically until cancelled. You can cancel at any time from the dashboard; cancellation takes effect at the end of the current billing period.
Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods or unused capacity.
We may change prices or plan features. We will give reasonable advance notice of price increases, and they take effect on your next renewal.
If a payment fails, we may suspend or downgrade your account until the balance is resolved.

4. Your content

You retain all rights to the code, files, data, and other materials you upload to or create with the Service ("Your Content"). You grant niles a worldwide, non-exclusive license to host, copy, transmit, display, and process Your Content solely as needed to operate and improve the Service and to provide it to you and anyone you share it with. You are responsible for Your Content and for having the rights necessary to use it with the Service.

5. Acceptable use

You agree not to use the Service to:

Violate any law or infringe anyone's intellectual property, privacy, or other rights.
Host or distribute malware, phishing pages, or content that is unlawful, deceptive, or harmful.
Send spam or unsolicited bulk communications.
Attempt to gain unauthorized access to the Service, other accounts, or our systems, or to disrupt or degrade the Service.
Use the Service for cryptocurrency mining, denial-of-service tooling, or other resource abuse.
Reverse engineer or resell the Service except as permitted by law.
Exceed plan limits through artificial means or share an account to circumvent limits.

We may investigate suspected violations and may suspend or terminate access to protect the Service or comply with the law.

6. Third-party services

The Service may interoperate with third-party tools and platforms (including Claude Code and other developer tools). Your use of those tools is governed by their own terms, and we are not responsible for them.

7. Intellectual property

The Service, including its software, design, and trademarks, is owned by niles or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in the Service except the limited right to use it as described here. Feedback you send us about the Service may be used by us without restriction or obligation.

8. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if your use poses a security or legal risk, if required by law, or if you fail to pay fees due. We may also discontinue the Service or any part of it with reasonable notice. On termination, your right to use the Service ends and we may delete Your Content after a reasonable period; please export anything you want to keep beforehand.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any data will not be lost. You are responsible for maintaining your own backups of Your Content.

10. Limitation of liability

To the maximum extent permitted by law, niles and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) US $100.

11. Indemnification

You will defend, indemnify, and hold harmless niles from any claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, give notice through the Service or by email. Changes take effect when posted, and your continued use of the Service means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of Ohio, USA, without regard to its conflict-of-laws rules. You and niles agree to the exclusive jurisdiction of the state and federal courts located in Ohio for any dispute that is not subject to arbitration or small-claims court, to the extent permitted by law.

14. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and niles regarding the Service.
If any provision is found unenforceable, the rest remains in effect.
Our failure to enforce a provision is not a waiver of it.
You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
